The way they use the interstate commerce clause is outrageous, as far as I’m concerned." These are his comments. I don't think it contradicts the constitution. Basically he is saying that he doesn't think the federal government should be nitpicking in the market, picking winnings/losers, and bailing out businesses. Not that the government doesn't have the right to decide a uniform bankruptcy law. In other words; he is talking about how the federal government circumvents the process of bankruptcy instead of letting the market decide. Not that the market would decide HOW bankruptcy happens but it would decide WHETHER bankruptcy happens. |
