You inadvertently made my point for me. Let me explain. The US Constitution is a list of enumerated powers. (Article I, section 8) Meaning anything not explicitly mentioned as a power of the federal government is not allowed. So it is not up to me to show "what part of the constitution prohibits the EPA", on the contrary, it is up to you to show me where it is explicitly allowed (which it isn't). Sam, the interstate commerce clause was originally intended to stop the common practice, at the time, of states taxing goods passing through their state on the way to other states. The current practice of using the "general welfare clause" and the commerce clause; to enable the federal government to have unlimited power is a perversion of the constitution. This is thoroughly documented in memoirs of the founders. They were very worried about the possibility of future leaders to use these clauses as a blank check. |
