Concerning the Legality of Banning Member Players

Not sure on all of this but a law school friend who I'd told about kdice mentioned that because Ryan has no stated TOS (Terms of Service), he has no legal ability to set scores to 0 or ban paying customer.
We have long assumed Ryan had autonomy with what he did in kdice. But after some talking and thinking, he lost that autonomy when he started accepting money. I'm not sure on the exact legal repercussions or the internet web laws or whatever, but I'm pretty sure what he is doing is illegal because he is denying a paid for service with no legal reason for ending it. The best case is that he should give refunds. I believe that he can reset points all he wants, bar the 2500 membership points that are paid for, and any points someone buys. Does anyone with more knowledge on the subject want to chime in? I'm curious about it, and all I can really find is that there is legal precedent on this issue in the past. |

at 12:33 AM, Sunday November 9, 2008 EST its a difference cody, you bought the fuel, but you lost the right to drive. your acc with 2.5k points, but still banned, i guess there is no difference at all.
and on the other hand: ryan thinks you cheated at the gameplay, so you could have lost your 2.5k points, instead of gaining more - wheres the truth? the other member could sue you for losing points of their membership bonus due inappropiate behaviour. ... we just dunno i guess. you both got your point, and after there are no reviews at all (damn, we really need em), i think you should discuss it with ryan, not with the community :( |

at 2:02 AM, Sunday November 9, 2008 EST oh, i forgot: we really need rules for getting banned i guess. its ok when ryan tries to keep the tops clean, but we need some official, and more important, PUBLIC banning behaviour.
so far, at least ryan and cody got a point ^^ (do i sense a marriage behaviour there?) |
