Concerning the Legality of Banning Member Players

Not sure on all of this but a law school friend who I'd told about kdice mentioned that because Ryan has no stated TOS (Terms of Service), he has no legal ability to set scores to 0 or ban paying customer.
We have long assumed Ryan had autonomy with what he did in kdice. But after some talking and thinking, he lost that autonomy when he started accepting money. I'm not sure on the exact legal repercussions or the internet web laws or whatever, but I'm pretty sure what he is doing is illegal because he is denying a paid for service with no legal reason for ending it. The best case is that he should give refunds. I believe that he can reset points all he wants, bar the 2500 membership points that are paid for, and any points someone buys. Does anyone with more knowledge on the subject want to chime in? I'm curious about it, and all I can really find is that there is legal precedent on this issue in the past. |

at 2:21 PM, Saturday November 8, 2008 EST It's not my cause or threat. As my membership was gifted I doubt that it would fall under any such category. And who goes to court over 5 dollars of bought points. I was throwing this out with the recent rash of bannings and resets, that I'm not sure are stopping anytime soon.

at 8:36 PM, Saturday November 8, 2008 EST damn tab button. Well, if you want to get this way about it, you may ahve a case Cody, but the fact that it's considered a donation does hamper your cause. It's not an obligation that you pay.
However, Ryan is supposed to give you 2,500 for donating. Although, did you already get the 2,500? if so, then you have no reason to bring up this bullshit. |
